General Terms and Conditions for the use of our GASTRO-4.DE - SERVICES and SERVICELEISTUNGEN.

Terms and definitions:

CUSTOMERS: Persons and companies from the catering industry.

GASTRO-4.DE: Service provider for all SERVICES offered.

WEBSITE & SHOP: Website and online store of the CLIENT to accept ORDERS and TABLE RESERVATIONS. 

GUESTS: Customers of our CLIENTS

SERVICES: Products services of GASTRO-4.DE

CUSTOMER SERVICES: Services that the CUSTOMER has to provide to his GUESTS. 

ORDERS: Orders and table reservations from GUESTS via the WEBSITE & SHOP  

ORDER MANAGEMENT: APP that manages all ORDERS for the CUSTOMER.

BACKEND: Protected customer area with a login to manage the content on the website and the store. 

GASTRONAUTEN: Personal support from GASTRO-4.DE for our CUSTOMERS

COSTS: Costs of GASTRO-4.DE

PAYMENTPROVIDER: Provider of payment options such as Pay Pal.

SERVICEPARTNER: External service providers

SERVICE PROVIDERS: Promotion & marketing, payment options, restaurant app.

SERVICE COSTS: External SERVICE PARTNER costs.

 

We provide the following SERVICES to our CUSTOMERS:

 

WEBSITE & STORE:

We create an individual website with a content management system and a web-based online store.

The website and the store are accessible via a desired domain. 

 

REACH & SEO:

GASTRO-4.DE creates for the CUSTOMER on request a profile at the following platforms:

  • Google My Business

  • Bing Places for Business

  • Gastro-4.Directory

  • FoodBooking

  • Tripadvisor

  • Yelp

 

Existing profiles on the part of the CUSTOMER can be adapted and optimized by GASTRO-4.DE.

 

SOCIAL MEDIA:

GASTRO-4.DE creates a profile for the CUSTOMER on request at the following social media channels:

  • Facebook

  • Instagram

 

Existing profiles on the part of the CUSTOMER can be adapted and optimized by GASTRO-4.DE.

By means of a smart link, direct access to the WEBSITE & SHOP of the CUSTOMER is guaranteed via the social media channels. 

 

GASTRONAUTES:

The support for our CUSTOMERS is called GASTRONAUT.

The GASTRONAUTS support the CUSTOMERS in all areas - the CUSTOMERS do not have to enter any data themselves. 

 

We provide the following SERVICES for our CUSTOMERS:

All SERVICE SERVICES are ordered directly by the CUSTOMER in BACKEND and paid to the SERVICE PARTNER. 

 

PROMOTION & MARKETING:

Individual campaigns are developed in cooperation with the CUSTOMER. 

Discount campaigns, vouchers, events, holiday offers, etc. are possible.

 

PAYMENT OPTIONS:

In addition to cash payment, there is also the option for the GUESTS to pay with a credit card, Pay Pal, Google Pay or Apple Pay.

The CUSTOMER must have previously created an account with the PAYMENTPROVIDER of their choice. 

PAYMENTPROVIDER fees will be agreed upon and billed directly to the CUSTOMER.  

 

RESTAURANT-APP:

GASTRO-4.DE creates a restaurant app for the CUSTOMER with the help of a SERVICEPARTNER. The restaurant app will be published in the Apple and Google stores after completion by the SERVICE PARTNER. 

 

PRICES AND SERVICE COSTS:

GASTRO-4.DE offers its SERVICES in tho variants, taking into account SERVICES provided by other SERVICE PARTNERS, as follows:
 

1. SHOP WITHOUT WEBSITE: 
 

  • SHOPSYSTEM

  • REACH & SEO

  • SOCIAL MEDIA

  • GASTRONAUTES

  • SERVICE: PROMOTION & MARKETING - 19 Euro monthly SERVICE COST.

  • SERVICE: PAYMENT VARIANT - 29 Euro monthly SERVICE COST.

Cost per month net: 119 euros.

In the total cost of 119 Euro the following SERVICE COSTS are already considered and included:

19 Euro per month for PROMOTION & MARKETING. 

29 Euro per month for various PAYMENT VARIANTS. 

These SERVICE COSTS are paid in BACKEND by the CUSTOMER directly to the SERVICE PARTNER. 

The difference of 71 Euro per month will be paid by the CUSTOMER to GASTRO-4.DE.

 

SHOP WITH WEBSITE:
 

  • WEBSITE & SHOP

  • REACH & SEO

  • SOCIAL MEDIA

  • GASTRONAUTES

  • SERVICE: PROMOTION & MARKETING - 19 Euro monthly SERVICE COSTS.

  • SERVICE: PAYMENT VARIANT - 29 Euro monthly SERVICE COST.

Net cost per month: 149 euros.

The total cost of 149 euros includes the following SERVICE COSTS:

19 Euro per month for PROMOTION & MARKETING.

29 Euro per month for various PAYMENT VARIANTS. 

These SERVICE COSTS are paid in BACKEND by the CUSTOMER directly to the SERVICE PARTNER. 

The difference of 101Euro per month will be paid by the CUSTOMER to GASTRO-4.DE.

 

RESTAURANT APP: 

 

  • SERVICE: RESTAURANT APP - 59 euros monthly SERVICE COST.

Net cost per month: 59 euros.

The total cost of 59 euros includes the following SERVICE COSTS:

59 Euro per month for the RESTAURANT APP. 

49 Euro per month for the POS-SYSTEMS.

These SERVICE COSTS are paid in BACKEND by the CUSTOMER to the SERVICE PARTNER.



POS-SYSTEM: 


  • SERVICE: POS-SYSTEM - 49 euros monthly SERVICE COST.

Net cost per month: 49 euros.

The total cost of 49 euros includes the following SERVICE COSTS:

49 Euro per month for the POS-SYSTEMS.

These SERVICE COSTS are paid in BACKEND by the CUSTOMER to the SERVICE PARTNER.


General:

Incoming ORDERS or TABLE RESERVATIONS will be provided to CUSTOMER via an ORDER MANAGEMENT APP. 

The CUSTOMER is solely responsible for his CUSTOMER SERVICES (ORDERS and TABLE RESERVATIONS). 

GASTRO-4.DE is not responsible for the CUSTMER SERVICES to its GUESTS.

GASTRO-4.DE ensures that the WEBSITE & SHOP, as well as all other SERVICES are available. 

 

Contract period:

Unless otherwise agreed, the contract period for all SERVICES and SERVICE, from the beginning of the publication of the WEBSITE & SHOP, can be terminated at any time and thus terminated.
 

Payment and default:

CUSTOMER agrees to pay all applicable COSTS and SERVICE CHARGES on time. 

All costs incurred will be invoiced by GASTRO-4.DE and must be paid by the 15th of each month.

All SERVICE COSTS incurred will be invoiced by the SERVICE PARTNER. 

The CUSTOMER is in default from the 16th day after the invoice due date, in case of non-payment. 

 

Termination:

If the CUSTOMER is 30 days in arrears with his payment, GASTRO-4.DE may give extraordinary notice of termination. 

Invoices outstanding until then remain unaffected. 

 

Final provisions:

The GTC is subject to German law. 

The place of jurisdiction for all disputes arising from this contract is Zweibrücken, as far as this can be legally agreed. 

GASTRO-4.DE can adapt these GTC at any time.

All changes to these GTC will be communicated directly to the CUSTOMER. 

Verbal side agreements to this contract do not exist. 

All changes to this contract must be in writing.

Should individual provisions of this contract be invalid or void in whole or in part void or ineffective as a result of a change in the legal situation or by the or by supreme court decisions or otherwise become wholly or partially invalid or void or or become invalid or void in whole or in part as a result of a change in the legal situation or as a result of supreme

parties agree that the remaining provisions of this contract shall remain unaffected and remain unaffected and valid.

 

Cancellation policy

Right of revocation

You have the right to cancel this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us WOOGY®, Brucknerstraße 9a, 66877 Ramstein-Miesenbach, support@woogy.de of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). For this purpose, you may use the enclosed sample revocation form, which, however, is not mandatory.

You can also fill out and submit the model withdrawal form or another clear declaration electronically on our website https://www.woogy.de/shop. If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail).

To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

 

Consequences of the revocation

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.You must return the goods without undue delay and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract to:

or to hand over. The deadline is met if you send the goods before the expiration of the period of fourteen days. You shall bear the direct costs of returning the goods.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
